Provider and contracting party: Vivere in Italien, Bastian Glumm (see Legal Notice). These terms apply to the booking of advertising space (header leaderboard) on vivereinitalien.de by entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB). Consumers are excluded from booking.
1. Subject of the contract
An advertisement is displayed in the header leaderboard (format 728x90 pixels) for a fixed term of 30 days from the selected start date. Each booking covers a single advertisement, with no automatic renewal.
2. Conclusion of the contract
By submitting the booking form and clicking the «Book with payment» button, the customer makes a binding offer. The contract is concluded upon receipt of payment and our confirmation by e-mail. We reserve the right to reject bookings without giving reasons; if a booking is rejected before the display begins, any amount already paid is refunded in full.
3. Prices and payment
The price is EUR 250.00 net plus 19 % VAT (EUR 297.50 gross) per booking (30 days). Payment is made in advance via the payment service provider Mollie. The advertisement is only displayed after receipt of payment and approval. The invoice is transmitted separately.
4. Banner creation and approval
After receipt of payment we create three banner drafts with AI support; the customer selects one. Display is subject to our editorial approval. We may reject advertisements that are unlawful, misleading, harmful to minors, discriminatory or incompatible with the brand environment.
5. Customer obligations
The customer warrants that the information provided by them (brand, message, target URL, logo and material) is free of third-party rights and does not infringe any rights. The customer indemnifies us against third-party claims arising from the content of their advertisement.
6. Term
The display runs for 30 days from the confirmed start date and ends automatically. There is no automatic renewal.
7. Availability and liability
We endeavour to display the advertisement continuously but do not owe uninterrupted availability. Short interruptions do not give rise to any claim for reduction or damages. Liability for slight negligence is limited to foreseeable damage typical of the contract; liability for intent, gross negligence and damage arising from injury to life, body and health remains unaffected.
8. Suspension, replacement and make-good display by the provider
The provider is entitled to temporarily suspend a booked advertisement at any time for objective reasons (in particular for editorial, design, technical, operational or economic reasons, as well as to protect the brand environment), to move it to another equivalent position or to replace it with another placement. If the suspension or removal is based on reasons within the customer's sphere (in particular unlawful, misleading or infringing content, or a breach of these terms), there is no claim to a refund or a replacement display. If the provider permanently takes the advertisement offline before the end of the term for reasons attributable to it, an equivalent replacement or make-good display of corresponding scope is provided at the provider's discretion; there is no claim to a cash refund, in particular to a pro-rata refund, to the extent permitted by law. There is no claim to uninterrupted display or to a specific placement. Further claims, in particular for damages or lost profit, are excluded to the extent permitted by law.
9. Entrepreneur status, no right of withdrawal
Booking is made exclusively by entrepreneurs (Section 14 BGB). There is no consumer right of withdrawal (see withdrawal notice).
10. Data protection
The processing of personal data is governed by our privacy policy. For payment processing, data is transmitted to Mollie B.V. (Netherlands).
11. Final provisions
German law applies. The place of jurisdiction is, to the extent permissible, the provider's registered office. Should individual provisions be invalid, the remainder of the contract remains valid.
